This document describes how we collect, use, store, share, and protect personal information when you visit our website (www.whitesun.ai), use our software-as-a-service platform, or otherwise interact with us (collectively, the “Services”), and the choices and rights you have.
We comply with the data protection laws applicable to us, including Mexico’s Federal Law on the Protection of Personal Data Held by Private Parties (the “Mexican Data Protection Law”) with respect to our users in Mexico, and applicable U.S. law. Sections 9 and 10 contain jurisdiction-specific rights.
This Policy applies to personal information we process about visitors to our website, prospective customers, business contacts, and users of our Services. It does not cover job applicants or employees, or information that is anonymized or aggregated so it can no longer identify you.
Where White Sun processes personal information on behalf of a business customer — for example, data our customers upload to or generate in the platform, including scenario simulations — we act as a processor, and that processing is governed by our agreement with the customer, who is the controller. Please direct requests about that data to the relevant customer.
This Policy does not apply to third-party websites, products, or services we do not control, even if they are linked from our Services.
We do not collect sensitive personal information. If it were ever necessary, we would do so only with your express consent and for the purposes disclosed to you.

White Sun is based in the United States, and personal information is processed and stored primarily there, where our service providers also operate. If you access the Services from outside the United States, including from Mexico, your information will be transferred to and processed in the United States. We require our service providers to maintain contractual safeguards consistent with this Policy and applicable law.
Our website uses cookies that are necessary for it to function, and HubSpot analytics and tracking cookies that help us understand how the site is used (pages viewed, form interactions) and follow up on inquiries you send us. We do not use advertising or cross-site tracking cookies for targeted advertising. You can disable or delete cookies through your browser settings, although some site features may be affected. We retain personal information only as long as necessary to fulfill the purposes described in this Policy or as required by law, after which it is securely deleted or anonymized.

If you are in Mexico, you have the right to access your personal data, rectify it when inaccurate or incomplete, cancel it, and object to its processing (“ARCO” rights), as well as to revoke consent you have given us and to limit the use or disclosure of your data.
To exercise these rights, send a request to security@whitesun.ai including: (i) your full name and a means of communicating our response; (ii) documents evidencing your identity or, where applicable, the legal authority of your representative; (iii) a clear and precise description of the data with respect to which you seek to exercise a right; and (iv) any information that helps us locate the data. We will respond within the timeframes established by the Mexican Data Protection Law and its secondary regulations.
If you believe your data protection rights have been violated, you may file a complaint with Mexico’s competent data protection authority for the private sector (currently, the Secretaría Anticorrupción y Buen Gobierno).
Depending on your U.S. state of residence, you may have rights to access, correct, or delete your personal information, to obtain a portable copy of it, and to opt out of the sale of personal information or its sharing for targeted advertising. White Sun does not sell personal information or share it for targeted advertising.
Regardless of whether a particular state law applies to White Sun, we will honor reasonable access, correction, and deletion requests from any U.S. user. To submit a request, or to appeal a decision on a request, contact us at security@whitesun.ai. We may need to verify your identity, and you may use an authorized agent with proof of authorization.
Our Services are directed to businesses and professionals and are not intended for individuals under 18. We do not knowingly collect personal information from minors, and we will delete such information promptly if we become aware of it.
We may update this Policy from time to time. The current version will always be posted at www.whitesun.ai/privacy with a revised “Last updated” date, and we will provide prominent notice of significant changes.
